THIS PROMOTION IS SPONSORED BY CENTIER BANK, 600 East 84^th AVENUE, MERRILLVILLE, INDIANA 46394.

ONLY INDIVIDUAL ACCOUNTHOLDERS OF BILLINERO® ONLINE SAVINGS ACCOUNTS WHO ARE AT LEAST 18 YEARS OF AGE AND RESIDE IN ARKANSAS, CONNECTICUT, ILLINOIS, INDIANA, KANSAS, MICHIGAN, MINNESOTA, MISSOURI, NEBRASKA, OREGON, SOUTH CAROLINA, OR VIRGINIA WHOSE ACCOUNTS ARE IN GOOD STANDING ARE ELIGIBLE TO PARTICIPATE. DURING THE PROMOTION PERIOD, ELIGIBLE DEPOSITORS IN PARTICIPATING STATES WILL RECEIVE (I) ONE ENTRY INTO A MONTHLY DRAWING FOR EACH INCREMENT OF $25.00 WITHIN A DEPOSIT TRANSACTION THAT IS MADE TO AN ELIGIBLE ACCOUNT (A “QUALIFYING DEPOSIT”) DURING THE ONE-MONTH PERIOD CORRESPONDING TO THE MONTHLY DRAWING (UP TO A MAXIMUM OF THIRTY-SIX (36) ENTRIES PER MONTHLY DRAWING); AND (II) ONE (1) ENTRY INTO A QUARTERLY DRAWING FOR EVERY THREE (3) ENTRIES INTO ONE OF THREE MONTHLY DRAWINGS DURING THE THREE-MONTH PERIOD CORRESPONDING TO THE QUARTERLY DRAWING. IN THE EVENT THAT YOU WITHDRAW MORE THAN 20% OF THE RESULTING BALANCE GENERATED BY YOUR QUALIFYING DEPOSITS, THE ENTRIES YOU RECEIVED FROM THOSE QUALIFYING DEPOSITS WILL BE VOIDED. YOU HAVE NOT YET WON.

EXCEPT FOR THE QUALIFYING DEPOSIT REQUIREMENT, NO PURCHASE OR PAYMENT OF ANY KIND IS REQUIRED TO ENTER OR WIN AND ANY SUCH PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE THE ODDS OF WINNING. DURING THE PROMOTION PERIOD, THERE WILL BE TWELVE (12) DRAWINGS TO WIN ONE (1) CASH PRIZE OF $1,000.00 (VERIFIABLE RETAIL VALUE: $1,000.00) IN EACH MONTHLY DRAWING AND FOUR (4) DRAWINGS TO WIN ONE (1) CASH PRIZE OF $1,000.00 (VERIFIABLE RETAIL VALUE: $1,000.00) IN EACH QUARTERLY DRAWING, FOR A TOTAL OF SIXTEEN (16) PRIZES. ACTUAL ODDS OF WINNING ARE BASED UPON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED FOR EACH DRAWING.

MAJOR RESTRICTIONS APPLY TO THE USE, AVAILABILITY, OR RECEIPT OF PRIZES. WINNERS MAY BE REQUIRED TO CONFIRM THEIR ELIGIBILITY, RELEASE US FROM LIABILITY, OR SUBMIT TO A BACKGROUND CHECK TO RECEIVE ANY PRIZE. EACH WINNER WILL BE RANDOMLY SELECTED IN MONTHLY AND QUARTERLY DRAWINGS, WHICH WILL BE HELD WITHIN TEN (10) CALENDAR DAYS AFTER THE END OF THE PRECEDING MONTH OR QUARTER.

These official rules (“Rules”) govern the Billinero® Savings Promotion Raffle (the “Promotion”) being sponsored by Centier Bank, an Indiana state-chartered bank.  Eligible depositors who open a Billinero® Online Savings Account (an “Eligible Account”) at Centier Bank and who make one or more Qualifying Deposits (as defined below) will be automatically entered into one or more drawings to win a cash prize, subject to the terms and conditions set forth below.  The purpose of the Promotion is to encourage depositors to grow and maintain savings deposits.  In these Rules, “we,” “us” and “our” refer to Centier Bank, the sponsor of the Promotion, and “you” and “your” refer to a depositor who is eligible to participate in the Promotion.

Eligibility

To enter and be eligible to participate in the Promotion, you must be a natural person who is eighteen (18) years of age or older at the time you open an Eligible Account and a legal resident of Arkansas, Connecticut, Illinois, Indiana, Kansas, Michigan, Minnesota, Missouri, Nebraska, Oregon, South Carolina or Virginia.  We may, in our discretion, permit legal residents of other states to participate in the Promotion in the future, which may result in a greater number of entries into each drawing and decrease the odds of winning.  We may also disqualify otherwise eligible entries of legal residents of any given state if we determine, in our discretion, that the Promotion is not permitted or violates any laws or regulations of such state or the Promotion would subject us to adverse legal consequences or unduly burdensome requirements in such state.  In the event that you become a resident of any state in which the Promotion is not being conducted at any time, you will no longer be eligible to participate in the Promotion.

The Promotion is open only to natural persons who are the primary accountholders of an individual Billinero® Online Savings Account at Centier Bank, as such account is described in the Truth in Savings disclosure that accompanies the consumer deposit “Terms and Conditions of Your Account” and further governed by other agreements we and you may have entered into from time to time, which may include, among other agreements, the Digital Banking Agreement, and the Electronic Communication Agreement (the “Account Agreements”).  A savings account in the name of a business entity, trust, estate, or other non-natural person, or which otherwise is held in a custodial, fiduciary, or representative capacity, is not an “Eligible Account” for purposes of this Promotion, and the primary accountholder is not eligible to enter or participate in the Promotion.  Employees, officers, directors, or agents of Centier Bank, its subsidiaries and affiliates, any advertising and promotion agencies directly or indirectly associated with the Promotion, and anyone living in the same households of such individuals, are not eligible to enter or participate in the Promotion.  Other types of bank accounts offered by us, including, but not limited to checking accounts, standard savings accounts, money market accounts, certificates of deposit and individual retirement accounts, are not “Eligible Accounts” for purposes of this Promotion.  Any deposit in accounts other than Eligible Accounts will not constitute a “Qualifying Deposit” for purposes of these Rules and will not result in any entry in the Promotion. 

In order to participate in the Promotion, you must be the primary accountholder of an Eligible Account as reflected in our records. The primary accountholder is the first person identified in our records as the owner of the Eligible Account and whose social security number is used for tax reporting purposes. You may maintain only one Eligible Account with us at any one time in which you are the primary accountholder, and to the extent that you are the primary accountholder on more than one Eligible Account, the Eligible Account that is opened first will be used for purposes of the Promotion and the other Eligible Account(s) will be disregarded for purposes of the Promotion.

At all times during the Promotion, you must maintain your Eligible Account in good standing, which we will determine in our reasonable discretion.  For example, we may determine that your Eligible Account is not in good standing if (i) we freeze, place administrative holds or posting indicators (such as “post no debits” or “post no credits or debits” indicators), or otherwise restrict transactions from being conducted by you or any other owner, agent, or other signer on the Eligible Account; (ii) we believe that the Eligible Account is involved in suspicious activity, suspected fraud, or other misuse; (iii) any government or quasi-governmental entity or body requires that the Eligible Account be closed; (iv) you have not complied with our requests for customer identification, beneficial ownership, or due diligence information with respect to you or the Eligible Account; (v) you have made any false statement or misrepresentation to us, in your application for the Eligible Account or otherwise; (vi) the Eligible Account is the subject of a legal proceeding (such as criminal prosecutions, garnishments, third party citations to discover assets, or asset seizures); (vii) the balance of the Eligible Account is escheated in accordance with applicable unclaimed property laws; (viii) we have chosen to prohibit you from doing business with us without closing the Eligible Account (such as situations in which you but not your Eligible Account’s co-owners have engaged in abusive behavior or pose a security threat to us); or (ix) we otherwise have reasonable cause to close your Eligible Account in accordance with the Account Agreements.

If you are selected as a winner of a prize, you may be asked to confirm your eligibility to participate in the Promotion prior to receiving the prize.  We may also require you to provide us with a release of liability, and permit us to perform a background check, as described in these Rules.

Any new Eligible Account is subject to our approval and the Account Agreements.  You will not be charged a fee or penalty for closing an Eligible Account.

How to Enter

The Promotion begins on October 1, 2023 and ends on September 30, 2024 and will automatically be extended for successive three (3) month periods thereafter, unless we elect to discontinue the Promotion, in which case we will provide you with notice. The period within which we conduct the Promotion, including any extensions, is referred to herein as the “Promotion Period.” Notwithstanding the foregoing, we reserve the right, in our sole discretion, to abbreviate, terminate or suspend the Promotion Period early.

During a Promotion Period, you will be automatically entered into (i) cash prize drawings based on Qualifying Deposits that you make in an Eligible Account during each calendar month (each drawing, a “Monthly Drawing”), and (ii) a quarterly cash prize drawings based on the amount of entries that you receive in the Monthly Drawings during the quarters ending December 31, 2023; March 31, 2024; June 30, 2024; and September 30, 2024 (each a “Quarterly Drawing”).

You will receive one (1) entry into a Monthly Drawing for each Qualifying Deposit made during each calendar month.  For purposes of the Monthly Drawings, Qualifying Deposits will be determined on a monthly basis.   A “Qualifying Deposit” is each increment of $25.00 deposited to your Eligible Account.  Accordingly, deposits of at least $50.00 will result in earning multiple entries into the Monthly Drawings.  In the event that you make a deposit of less than $25.00, such deposit will not be a Qualifying Deposit and will not carry over toward the calculation of a future Qualifying Deposit.  In the event that you make a deposit of greater than $25.00 but with an additional increment of less than $25.00, that additional increment will not be a Qualifying Deposit and will not carry over toward the calculation of a future Qualifying Deposit.  Qualifying Deposits are deemed made in a given month when the deposit transaction including the Qualifying Deposits becomes available for full withdrawal under our funds availability policy (as disclosed in our Account Agreements) on or after 12:00 a.m. Central Time, on the first calendar day of that month and prior to 11:59 p.m. Central Time on the last day of that month.  To the extent that any Qualifying Deposit to your Eligible Account is not available under our funds availability policy until the succeeding month, such Qualifying Deposit will be deemed a Qualifying Deposit made in the succeeding month, unless the Promotion Period has ended.  Qualifying Deposits may be made by any method permissible under the Account Agreements, which may include electronic checks or automated clearing house entries.  Qualifying Deposits may be submitted to us via your digital banking profiles or by instructing others to make deposits to your Eligible Account.

You will receive one (1) entry into a Quarterly Drawing for every three (3) entries that you receive for one of three Monthly Drawings included in the three-month period corresponding to a calendar quarter. Any remaining Monthly Drawing entries within a given month that are in an increment of less than three (3) will not receive a Quarterly Drawing entry, will not carry over to and be included in the calculation of a Quarterly Drawing entry in any succeeding month, and will not carry over to and be included in a succeeding Quarterly Drawing.  To the extent that any Monthly Drawing entry is voided as a result of a deposit withdrawal, as described below, such Monthly Drawing entry will not count towards your eligibility for a Quarterly Drawing entry.

You may receive a maximum of thirty-six (36) entries for each Monthly Drawing.  You may receive a maximum of thirty-six (36) entries for each Quarterly Drawing.  To the extent that you could have qualified for additional entries, these will not carry over to and will not be included in a succeeding Monthly Drawing and/or Quarterly Drawing.

Subject to any limits on transaction activity described in or otherwise in accordance with the Account Agreements and applicable law, you are generally not restricted from making withdrawals from your Eligible Account.  However, withdrawals from your Eligible Account may reduce the amount of entries that you have earned. IN THE EVENT THAT YOU WITHDRAW MORE THAN 20% OF THE RESULTING BALANCE GENERATED BY YOUR QUALIFYING DEPOSITS, THE ENTRIES YOU RECEIVED FROM THOSE QUALIFYING DEPOSITS WILL BE VOIDED. Please refer to the attached example transaction history to help you understand how entries may be earned or voided.

We reserve all rights under our Account Agreements, the funds availability policy applicable to the Eligible Accounts, and applicable law, regulation, operating circulars, and payment association, clearing house, and network rules and guidance to return, reject, place extended holds on, or otherwise delay the availability of Qualifying Deposits, which may result in entries being deemed earned and effective at later dates than such entries otherwise would have been deemed earned and effective.

If we determine that your Eligible Account is no longer in good standing, any additional deposits that you make after this determination will not be “Qualifying Deposits” for purposes of this Promotion and will not receive any additional entries.   If we determine that any otherwise valid entries were obtained through suspicious activity, suspected fraud, or other misuse of the Eligible Account, then entries may be disqualified from being selected in any drawing.

Drawings and Prizes

During the Promotion Period, we will conduct separate drawings for the following cash prizes:

• For each Monthly Drawing, one winner will be randomly selected from all eligible Monthly Drawing entries and will receive a cash prize of $1,000.00. The verifiable retail value of the prize is $1,000.00. Actual odds of winning are based upon the number of eligible entries received. Prizes are not transferable.
• For each Quarterly Drawing, one winner will be randomly selected from all eligible Quarterly Drawing entries and will receive a cash prize of $1,000.00. The verifiable retail value of the prize is at least $1,000.00. Actual odds of winning are based upon the number of eligible entries received. Prizes are not transferable.

Selection of Winners

On or before the tenth (10th) calendar day of each month during the Promotion Period, one (1) winner will be randomly selected in a Monthly Drawing from all eligible entries received during the preceding calendar month. On or before the tenth (10th) calendar day of the first month following the end of a calendar quarter during the Promotion Period, one (1) winner will be randomly selected in a Quarterly Drawing from all eligible entries received during the preceding calendar quarter.  Each entry, regardless of how the entry is earned, has an equal chance of winning at each drawing.  Actual odds of winning are based upon the number of eligible entries received.  You are not required to be present at any drawing to win.

Winners will be notified by email, phone, or mail as we may determine in our discretion, depending on the contact information that we have on file, subject to applicable law.  You are solely responsible for providing us with an accurate and complete e-mail address, telephone number, and mailing address and to maintain and update any changes to this information promptly.  If your contact information should change in the future, you must notify us.  We do not monitor our systems or mailboxes for e-mails or mail that is returned to us as undeliverable and might not attempt to resend any returned e-mail or mail to you.  We do not undertake any duty or obligation to determine the correct e-mail address, telephone number, or mailing address through which we will attempt to communicate with you.  We will exclusively rely on the contact information that you provide to us and shall be protected to the fullest extent permitted by applicable law in so relying.  If you fail to provide us any e-mail address, telephone number, or mailing address through which we are permitted to contact you, any of your entries that are later selected as winning entries may be disqualified and a new winner may be selected.

Major restrictions may apply to the use, availability, or receipt of prizes.  If we require a response, winners must respond to a notification no later than 12:00 p.m., Central Time, on the date that is seven (7) calendar days after we send this notification to claim a prize.  Winners may be required by us, to the extent permitted by applicable law, to complete, sign, and return an affidavit confirming the winner’s eligibility to participate in the Promotion and a release of liability prior to distribution of the prize.  A potential winner may be required to submit to a confidential background check to confirm eligibility and help ensure that the use of any such person in advertising or publicity for the Promotion will not bring us into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Promotion or us as we may determine in our sole discretion.  If the winner does not respond to notification within the time specified above or, if applicable, return the completed affidavit or release by the time specified by us, then the winner’s entitlement to the prize may be forfeited, and the prize may be awarded to an alternate winner in a random drawing from the remaining eligible entries.

Prize winnings will be credited to the Eligible Account of the winner.  Prizes are non-transferable and may not be substituted for a different prize or satisfied by different payment methods.

Tax Implications

All applicable federal, state, and local taxes and any expenses associated with any prizes awarded are the sole responsibility of the winner.  We may provide any winner a Form 1099-MISC or similar tax forms if and to the extent required by applicable law.  Winners should seek the advice of their own legal or tax professionals regarding the tax implications of accepting a prize.

Limitations of Liability

By participating in the Promotion, you agree to abide by and be bound by these Rules and to accept any decisions or determinations made by us pursuant to these Rules as final, conclusive, and binding.

To the fullest extent permitted by applicable law, Centier Bank, its subsidiaries and affiliates, and the  officers, directors, employees, and agents of Centier Bank, its subsidiaries and affiliates (collectively, the “Promotion Parties”) shall not be responsible or liable for, and you agree to release, discharge, defend, indemnify and hold the Promotion Parties harmless from and against, any claims, liabilities, damages, losses or liability resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse or use of a prize, or any portion thereof, or participation in the Promotion or any Promotion-related activities, including any and all costs and attorneys’ fees incurred in responding to and/or defending such claims, and you agree that (i) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, consequential, special, exemplary, or any other damages, other than damages for actual out-of-pocket expenses; (ii) all causes of action arising out of or connected with the Promotion, including but not limited to any prize awarded or use of any entry, shall be resolved individually, without resort to any form of class action; and (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.

Without the generality of these Rules, we are not responsible for: (i) entries that are lost, late, stolen, damaged, garbled, destroyed, or misdirected; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network or, software; (iv) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or programming associated with or utilized in the Promotion; (v) any typographical or other error in any printing or advertising related to the Promotion; or (vi) cheating or fraud by any entrant.  We shall not be liable to any winner for failure to supply the prize, or any part thereof, by reason of any acts of God; any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid; equipment failure; terrorist acts; air raid; blackout; act of public enemy; earthquake; war (declared or undeclared); fire; flood; epidemic; explosion; unusually severe weather; hurricane; embargo; labor dispute or strike (whether legal or illegal); labor or material shortage; transportation interruption of any kind; work slow-down; civil disturbance; insurrection; riot; or any other cause beyond our sole control.

Privacy

We will collect the personal information submitted in connection with the Promotion by you.  By entering the Promotion, you agree that, subject to applicable law, your personal information may be used by us, or our agents or contractors, for administrative, promotional and marketing purposes, including, without limitation, communicating with you about the Promotion, identifying products and services for which you may be eligible and offering services to you.  We also may disclose names and other personal information of winners selected as may be required by applicable law.  By entering the Promotion, unless otherwise prohibited by law, you grant us the right, without limitation or further permission or compensation, to use and publish your name and likeness for promotional, advertising, publicity and marketing purposes in any manner in commerce and in any medium no known or later devised throughout the world in perpetuity without limitation and without further notice or approval.  We may require you to execute documents to confirm the grant of rights hereunder, and failure to do so may result in disqualification from this Promotion. The personal information of entrants will not be used by us for any purpose other than those described above.

Miscellaneous

By entering, you agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules and your or our rights and obligations in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of State of Indiana without giving effect to any choice of law or conflict of law rules.  By entering, each entrant consents to the jurisdiction and venue of the federal, state and local courts for Merrillville, Indiana.

The Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited by law. In the event we are prevented from continuing or completing the Promotion in whole or in part, or the integrity or feasibility of the Promotion is undermined by any event or cause not reasonably within our control, including but not limited to technical, telephonic, hardware, software, network computer, data transmission, incomplete entries, electronic disruption, virus, bugs, tampering, printing or production errors, or other causes beyond our control that disrupt the administration, security or proper play of the Promotion, we shall have the right, in our sole discretion, to abbreviate, modify, suspend, cancel or terminate the Promotion without further obligation. If we elect to abbreviate the Promotion, we reserve the right to randomly select a winner for prizes from among all eligible entries received up to the time at which we elected to abbreviate the Promotion.  To the fullest extent permitted under applicable law, we reserve the right to modify or amend these Rules at any time in our sole discretion.  We will notify you of any such modifications or amendments if and to the extent required by applicable law.  Upon expiration or termination of the Promotion, we may convert your Eligible Account into a standard savings account with the same deposit terms and conditions but which is not linked to the Promotion.  We may also close your Eligible Account in accordance with the Account Agreements on or after the date of the Promotion terminates or expires.

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision of these Rules is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.  In the event there is a discrepancy, inconsistency, or conflict between disclosures or other statements contained in any Promotion-related materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.

All of your and our other rights and responsibilities with respect to your Eligible Account are governed by your Account Agreements.  If and to the extent there is any conflict and inconsistency between these Rules and the Account Agreements, the Account Agreements shall govern and control.
